The Noxious Weed Ordinance
is in effect from April 15 through October
30 each year.
Complaints are taken anonymously and inspected normally
within a day or two. If the lot is determined to be in violation,
a letter will be sent to the property owner. While there
are many rules that determine if a lot is in violation,
the main ones a complaintant should keep in mind are that
the grass must be at least 12" high on average across
the lot, and the lot may not be over two acres in size.

Below is an excerpt of the rules and rates from the
violation letter (please note these are not all-inclusive):
Chapter
11, Article II of the Delta Charter Township Code Of Ordinances.
Said Ordinance is to provide for and regulate the
cutting and growth of grasses and noxious weeds within the
Township as per Act 359 of 1941 as amended.
Under
the provisions of this ordinance you are required to cut
or otherwise destroy by lawful means all grasses or noxious
weeds on the property on or before April 15 and to keep
said grasses and weeds cut to the height of less than twelve
inches on the average throughout the growing season.
From the date of this correspondence,
you have ten (10) days to bring the property into compliance
yourself and thereby avoid all charges.

Properties
not COMPLETELY
brought into compliance shall be mowed by the Township or
its agent and all costs assessed against said property.
The cost of the mowing, to include equipment usage,
transportation, man hours involved, and overhead, will be
charged to you. When
there is a group of lots, with common lot lines, under the
same ownership, these lots will be charged the minimum charge
for the first lot, plus the hourly mowing rate for each
additional lot. The
minimum charge, as explained on the back of this letter,
shall be in effect for all properties.
Single lots requiring more than one hour mowing time
will be charged the minimum rate plus the hourly rate for
mowing.
Costs assessed
prior to August 1, 200x and not paid by September 1, 200x
will be spread on 200x tax rolls.
Any costs assessed after August 1 are due within
30 days from the date of billing.
Delta
Township or its agent will not be responsible for damage
to buildings, vehicles, landscape, trees, shrubs, etc. occurring
during the mowing of property in violation of this ordinance.
In
compliance with P.A. 1941, No. 359: Effective, January 10,
1941, as amended, regarding cutting of noxious weeds in
the Township, I, Joseph Drolett as Township Supervisor,
do hereby authorize Dick Benkert as Weed Commissioner, to
cut and maintain all properties covered by this act and
to bill the property owner for all costs up to and in excess
of $25.00. It
is understood that the charge schedule has been established
based on the following:

The
above schedule depicts the minimum charge in effect for
all lots each time the lot is mowed by the Township or its
agent.
In the case of adjoining lots with the same owner,
only the mowing charge will be in effect for the second
and all subsequent lots.
