Civil Infractions

This ordinance is intended to streamline the enforcement process. Compliance within a reasonable time is the goal.

After a complaint has been received by the Building Department and an inspection has been conducted, A Correction Notice may be written and sent to the responsible parties. This warning will contain a given due date or time limit by which to correct the listed violations.

Extensions may be given by the Code Enforcement Officer for adequate cause.

If the violation still exists, after the allotted time given by the Correction Notice, a Notice of Violation (ticket) may be issued. If you receive a Notice of Violation:

You may Admit Responsibility and pay the set fine to the Violations Bureau located in the Delta Township Accounting Department; or

You may Admit Responsibility with Explanation. In this case you must contact the Delta Township Building Department on or before the date specified. A Civil Infraction Citation will be issued for the responsible parties to appear in District Court within 14 days; or

You may Deny Responsibility by contacting the Building Department on or before the date specified. A Civil Infraction will be issued for the responsible parties to appear in District Court within 14 days.

Fines are as follows:

• First offense: $50.00
• First repeat offense (if within a 12-month period): $125.00
• Second repeat offense: (if within a 12-month period) $250.00
• All subsequent offenses: (if within a 12-month period) $400.00

Each day that a civil infraction continues constitutes a separate offense and shall be subject to fines and costs as a separate offense.

The court may order the violations to be corrected along with the fine, or find some other remedy for the violations.
